The Persistent Problem of "Professional Tenants": A Cautionary Tale for Landlords

by Billy Abildgaard

Finding a secure, affordable place to live in Massachusetts is already a challenge, but imagine being a landlord and discovering that your new tenants have no intention of paying rent. This is the unsettling reality faced by many property owners across Worcester County, who have fallen victim to a pair of "professional tenants" exploiting the system to live rent-free for years.

The Deceptive Game of Professional Tenants

The term "professional tenants" refers to individuals who have mastered the art of scamming landlords, particularly in states like Massachusetts, where tenant protections are strong. These individuals can drag out the eviction process for months, sometimes even years, using legal loopholes and delaying tactics to prolong their stay without paying rent. By the time the eviction is finalized, they are already preparing to repeat the cycle with a new, unsuspecting landlord.

A recent NBC10 Investigation has brought to light the case of Russell and Linda Callahan, a husband-and-wife duo who have seemingly perfected this scam over the past two decades. The Callahans have repeatedly duped small property owners across Worcester County, leaving behind a trail of unpaid rent, damaged properties, and legal battles.

How the Scam Works

The Callahans make a strong first impression. They present themselves as a wholesome, all-American couple, armed with a stack of seemingly legitimate paperwork, including pay stubs, background checks, and credit reports. This documentation is designed to put landlords at ease, convincing them that they are trustworthy tenants.

However, once the lease is signed and the keys are handed over, the problems begin. The first rent check invariably bounces, and the Callahans offer a litany of excuses—ranging from IRS issues to delayed 401k transfers or a family emergency. By the time the landlords realize they've been scammed, the Callahans are firmly entrenched in their new home.

The eviction process then becomes a lengthy and costly ordeal. Massachusetts law often requires landlords to pay for moving and storage expenses following an eviction, further compounding their financial losses. Over the years, the Callahans have been evicted at least 16 times in Massachusetts alone, with judgments for unpaid rent totaling over $100,000. When legal fees, moving costs, and property damage are factored in, the total losses skyrocket even higher.

The Legal System and Its Loopholes

Despite their extensive history of evictions, the Callahans have managed to evade serious consequences. Linda Callahan's criminal record includes more than 50 charges, primarily for writing bad checks and falsifying records. Yet, her sentences have typically been limited to short jail stints or probation. The Callahans' ability to manipulate the legal system has allowed them to continue their rent-free lifestyle with little more than the inconvenience of relocating every few years.

Worcester attorney Henry Raphaelson, who has dealt with the Callahans in multiple eviction cases, warns landlords to steer clear of them at all costs. He describes them as individuals who should never be rented to under any circumstances, as their tenancy always ends in financial disaster for the property owner.

A Message to Landlords

As the owner of Digital Realty, a real estate brokerage committed to protecting property owners, I feel it is crucial to raise awareness about the dangers of professional tenants like the Callahans.

This case serves as a stark reminder of the importance of thorough tenant screening and due diligence. While the Callahans may have perfected their scam, there are steps landlords can take to protect themselves:

  1. Conduct Comprehensive Background Checks: Verify all documents provided by potential tenants. Cross-check employment records, and reach out to previous landlords for references.

  2. Stay Informed About Tenant Rights and Eviction Laws: Understanding your rights and the legal process in your state can help you navigate potential disputes more effectively.

  3. Work with a Trusted Real Estate Brokerage: Partnering with a reputable brokerage like Digital Realty can provide you with the resources and expertise needed to manage your properties and protect your investments.

The case of the Callahans is a sobering example of how a lack of vigilance can lead to significant financial losses for landlords. At Digital Realty, we are committed to helping property owners avoid such pitfalls and ensure that their investments are secure.
